Survival of Tort Actions (remedy for harm to the victim)
A victim's COA will survive to permit recovery of all damages from the time of injury to the time of death. Spouse can bring an action.
Wrongful Death
A decedent's spouse may recover for the loss resulting from their spouse's death.
A spouse may recover damages for loss of consortium or services
Damages
Compensatory Damages are awarded to the plaintiff to compensate for injury or loss. The goal is to put the plaintiff in a position before the tort. They are measured by the monetary value of the plaintiff's harm.
Two types of compensatory damages. General damages are non-economic losses attributable to the tort because they flow as a natural result. Special damages are economic losses that are unique to each plaintiff.
Limitations to overcome are causation, foreseeability, certainty, and unavoidability.
Is the tort the but-for cause of the damage?
Is the damage reasonably foreseeable at the time of conduct?
Is the loss able to be calculated with certainty and not overly speculative?
Did the plaintiff take reasonable steps to mitigate his loss?
Nominal Damages are awarded where the plaintiff's rights have been violated, but the plaintiff sustained no loss. They serve to vindicate the plaintiff's rights. Not available where damages are an element of the cause of action, like negligence or conversion.
Punitive Damages are awarded where the defendant has displayed willful, wanton, or malicious tortious conduct. They are measured by an appropriate punishment for the defendant's misconduct. Requires: (1) the reprehensibility of the defendant's conduct; (2) the ratio between punitive and compensatory damages (single-digit ratios are the guidepost); and (3) a comparison to civil penalties in similar cases.
Legal Restitution
Money restitution may be obtained if the defendant has been unjustly enriched at the plaintiff's expense. Elements 1) benefit conferred, and 2) unjust enrichment. Was the defendant a conscious wrongdoer or an innocent or negligent recipient?
Replevin may be obtained, even before trial, if personal property was wrongfully taken. Plus, damage for loss of use. 1) Is the defendant wrongfully in possession of personal property? 2) Is the plaintiff seeking the return of the specific property, and was there a loss of use?
Ejectment plus loss of use damages may be obtained if the plaintiff 1) has title and 2) right to immediate possession of the land. If the defendant is in innocent possession, they may offset improvements with damages.
Equitable Remedies
Constructive trust can be created to convey title to a specific piece of property. An equitable lien may be imposed on a property to act as collateral for money owed. Both remedies require 1) there was a wrongful act, 2) there is an inadequate legal remedy, 3) the defendant has title, and 4) property is traceable. The investor-spender fiction presumes the defendant invests or spends his own money first, and any remaining balance is from the wrongfully obtained funds after his own funds are exhausted.
CT requires property to be fairly traceable to the new asset. If the money owed is traced to an account, then recovery is limited to the lowest intermediate balance rule. A plaintiff cannot get a constructive trust if the property has been transferred to a bona fide purchaser (BFP).
EQ allows for tracing when it cannot be solely traced to a new asset. Also provides for the deficiency judgment, though if currently uncollectible, it preserves P's right to pursue the remaining debt in the future. But limits recovery to money owed.
Equitable defenses available for CT and EQ remedies
Laches defense is available when the plaintiff has unreasonably delayed in bringing the action, and this delay has resulted in prejudice to the defendant. Did the plaintiff wait a long time before filing the lawsuit, despite being aware of the facts that gave rise to their claim? Did the defendant change their position in reliance on the plaintiff's inaction or lose the ability to defend the claim?
The unclean hands defense is available when the plaintiff has conducted herself unfairly in the transaction in dispute. Did the plaintiff engage in any wrongful or unfair acts? Is the plaintiff's wrongful act directly tied to the subject of the lawsuit?
To prevent a plaintiff from achieving a double recovery for a single loss, A plaintiff can elect to recover either compensatory damages (based on their loss) or money restitution (based on the defendant's gain), but not both.
