this quote is misattributed, badly. Only someone who was completely unfamiliar with who de Tocqueville was and when he lived could mistake this for his quote. The first reference to this quote I can find is from P.J. O'Rourke's speech at a Cato Institute event in 1993.

By George he's right! And you know what? There's no such thing as justice? The "right" to a fair trial? Fair play? What stupid and backward concepts! Why, we should throw out the entire body of legal knowledge right out the window, and settle all our disputes through duels to the death, like REAL men.
